Welcome to Nutri For Families Counselling ("Nutri For Families," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website (the "Site") and any professional nutrition and counselling services ("Services") provided by Nutri For Families. Please read these Terms carefully; by accessing the Site, creating an account, booking or attending Services, and purchasing content, or using free materials, you agree to be bound by these Terms and our Privacy Policy.

1. Definitions

• Client: Any individual or entity who registers for or receives Services from Nutri For Families.

• Services: Nutrition and lifestyle counselling, educational materials, meal planning, group workshops, and any related professional support.

• Site: www.nutriforfamilies.com and any affiliated subdomains or mobile applications.

• Privacy Policy: Our policy governing data collection and processing, incorporated by reference.

2. Scope of Services

1. Description: Nutri For Families provides evidence-informed nutrition counselling, preventive education, and lifestyle coaching to promote healthy families and communities.

2. Professional Status: Our practitioners are qualified nutritionists and health educators, but not regulated health professionals under the Regulated Health Professions Act, 1991 (Ontario). Our Services do not substitute for medical diagnosis or treatment.

3. No Guarantees: While we strive for positive outcomes, individual results may vary. We make no guarantees regarding specific health results.

3. Client Obligations

1. Accurate Information: You must provide complete and truthful information about your health history, dietary restrictions, and current conditions.

2. Medical Advice: You acknowledge that you will seek medical advice from a qualified health professional for any medical or clinical issues.

3. Compliance: You are responsible for following any agreed-upon plans and for consulting your physician before making significant lifestyle or dietary changes.

4. Booking, Fees & Payment

1. Fees: Fees for Services are as listed on the Site or in a separate signed agreement. All amounts are in Canadian Dollars (CAD).

2. Payment Schedule: Unless otherwise agreed, payment in full is due at the time of booking.

3. Late Payment: Overdue payments may incur interest at 1.5% per month (18% per annum) or the maximum permitted by law.

4. Cancellation & Rescheduling: Cancellations or rescheduling requests must be made at least 24 hours before the scheduled appointment. Late cancellations or no-shows will forfeit full payment.

5. Refunds: Except as expressly stated, all fees are non-refundable once Services have commenced.

5. Confidentiality & Data Protection

1. Client Confidentiality: All personal information and session content are kept strictly confidential except where disclosure is required by law (e.g., risk of harm).

2. Data Security: We employ administrative, technical, and physical safeguards to protect your data in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA).

3. Third-Party Processors: We may engage third-party service providers (e.g., video conferencing, payment processors); their handling of data is governed by their own policies.

6. Intellectual Property

1. Ownership: Nutri For Families retains all intellectual property rights in the Site, branding, content, and materials (e.g., meal plans, guides).

2. Limited License: Clients receive a limited, non-exclusive license to use materials for personal, non-commercial purposes only. Modification, distribution, or commercial use is prohibited.

7. Third-Party Links & Resources

Our Site may include links to third-party sites or resources. These are provided for convenience; we do not endorse or assume liability for third-party content, services, or privacy practices.

8. Warranties & Disclaimers

1. As-Is: The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied.

2. No Professional Guarantee: We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Nutri For Families’ total liability arising from or related to these Terms, whether in contract, tort, or otherwise, shall not exceed the total fees paid by the Client for the specific Service giving rise to the claim in the three (3) months preceding the event.

10. Indemnification

You agree to indemnify and hold harmless Nutri For Families, its officers, directors, employees, and agents from any claims, losses, liabilities, and expenses (including legal fees) arising out of your breach of these Terms or your negligent or wrongful acts.

11. Force Majeure

Neither party shall be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, government orders, pandemics, or network failures.

12. Termination

We may suspend or terminate access to Services or the Site at any time for breach of these Terms. Upon termination, all outstanding fees become immediately due, and any license to use our materials will cease.

13. Governing Law & Dispute Resolution

1. Governing Law: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

2. Dispute Resolution: Parties agree to first attempt mediation. If unresolved within 30 days, disputes will be finally resolved by arbitration in Ottawa, Ontario, under the Arbitration Act, 1991 (Ontario).

14. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

15. Amendments

We may amend these Terms at any time by posting an updated version on the Site. Continued use of the Site or Services after amendments constitutes acceptance of the revised Terms.

16. Entire Agreement

These Terms, along with any separate agreements and the Privacy Policy, constitute the entire agreement between you and Nutri For Families regarding your use of our Services and supersede all prior agreements.
